Personal injury claims belong to the category of civil claim or the tort law. Tort claims basically deal in two important elements – damages and liability. Personal injury claims take into account all those instances wherein an individual has been through severe physical injury or damage that has been caused by the negligence of a third party involves, which becomes the liability of the third part. There can be various different forms of the cause of injury, and the most common type of a personal injury claim includes automobile or car/bus/truck accidents, medical malpractice, slip and fall accidents and animal bites (such as pet bites, including dogs and cats).

The compensation amount that can be claimed for a personal injury varies. It is based on certain components of an individual claim. Multiple factors will be considered, such as the nature of injury sustained, whether the injury that has been caused is a permanent damage or not, the extent of applicable insurance coverage, the total amount of the medical bills, lost wages if any, travel expenses related to the injury, additional expenses related to the injury and the pain and difficulties experienced by the sufferer.

There are certain limitations associated with a personal injury claim; in fact, these limitations imply to all types of personal injury claims. There is a certain time frame till which the claim can be pursued legally.  If the time period lapses, the claim will be barred and therefore it cannot be recovered later. If you want to pursue the claim, you need to do it prior to your statute of limitations.  However, the statue of limitations will also vary on certain conditions, sc as the pace of injury, time etc.

It is always advised to consult an attorney regarding the specific details of an individual personal injury claim. With the help of an attorney you can get proper advice regarding the insurance coverage and how it will work for you. You can also learn how to proceed with the claim, what are your rights and limitations and how you can be a winner. Also, you will learn more about the precise statute of limitations that will help you in pursing your personal injury claim more efficiently. Attorneys usually have prior experience in all such situations and they can actually help you to win the case. Since the common man has very little information about how a personal injury claim is carried forward and what could be the probable questions related to the complaint, expert’s opinion and guidance will make a difference to your claim.

There are 3 ways of resoling a personal injury claim:

1. Negotiation Settlement that can be done either without filing a legal suit or after filing a suit. The deal is negotiated between the two parties.
2. Through formal arbitration in which there is a legal case involves.
3. Through a jury trial; a case of a trial as you normally see.

Each method has its own advantages and disadvantages. However, if an out-of-court settlement or negotiation can be done, it is much better in every ways.
